In a pre-trial hearing Jan 10, a federal judge will hear arguments for a “summary judgment” from both sides in developer Phil Tagami’s lawsuit against the City of Oakland for barring his plan to build a coal export terminal. Tagami’s company, the Oakland Bulk and Oversize Terminal, as well as the Sierra Club/SF Baykeeper and the City of Oakland will all try to get the judge to make a decision on the spot.
No Coal In Oakland supporters are encouraged to come to the pretrial hearing and observe. To get past security at the Federal Building, you must present government-issued picture ID such as a driver’s license. Judge Chhabria’s courtroom is Courtroom 2 on the 17th Floor. The hearing will begin promptly at 10 a.m.; come at 8:30 a.m. for rousing rally before entering the courthouse.
